I don't know anything about law and haven't followed this but seen it pop up now, surely this should go to the courts and let them decide? Why is he not being charged for killing someone and let the judicial system decide whether he was justified in doing so?

This is completely incorrect. All the Crime and Courts Act 2013 did (as referred to in the the Secret Barrister post which cites the Denby Collins case) was to confirm the existing position that grossly disproportionate force can never be deemed reasonable. Yet another piece of terrible legislation from Grayling which didn't have the effect he'd hoped for.

Itís fairly simple and even you could understand. I donít think taking the piss out of a man in his 70s who has just gone through a dramatic experience, and by all accounts lived a quiet life whilst looking after his wife is funny.

CPS, use of public funds.

Seriously!!!!

Two guys in his house after midnight robbing him. He's 78. A court case could kill him.

I'd be more inclined to offer him a new home so that this wonderful family can't get at him as they most likely will do.

My dad suffered a similar thing. They ransacked his house while he sat there terrified and then punched him as they left. As a reminder to keep quiet or they would be back to finish him off.

He reported it to the OB, picked them out of images and they were arrested and sent down.

Some people are scum and if they accidentally get killed whilst committing a crime. Tough. Why should an innocent person get dragged though the courts. If the criminal was not there it would not have happened.

That's not how it works. If the Police and/or CPS either think there isn't enough evidence to charge or alternatively the probability of conviction is low then there's not much point, not to mention they potentially leave themselves open to sanction.

The Crown Prosecution Service (CPS) decide whether criminal charges are to be pressed.

I am pleased my taxes are not to be wasted on prosecuting a pensioner and also that my monies are not going towards yet another incarceration of a perpetual criminal who preyed on the vulnerable.

Like I said before. Take him away and put him somewhere safe. Donít think it would have been good to leave him in his house until the Police had done a risk review
