It's a Police matter and I am sure if it's self defence or murder /Manslaughter the prosecution service will way up the evidence and come to the right decision .

Usually it goes to trial, I'd imagine it would be down to what the other suspected burglar says. Usually you need eye witnesses to attest to self defence for the CPS to be sure. Of course, in doing so, he puts himself in line for a burglary and potential manslaughter case (kind of like a US Felony Homicide if the responsibility to break in was his idea).

it should be.

Some would have him googling the odds on him being harmed, issue 3 warnings and only then should he attack.

It warms the cockles of my heart when a burglar gets his comeuppance like this. Our judicial system does very little to discourage burglary so this is one back for the good guys.

Unfortunately, in our upside down country, the householder will likely end up in prison and the burglar's nearest and dearest will bring a monster civil claim.

Defence of your family ok? If someone was burgling my abode that would be my priority and one would have to assume that they do mean harm or at the very least tooled up to inflict harm.

Surely, if i did happen to kill them due to the worry and stress of the situation imposed on me by them had affected my psychology, that would be a decent defence?

Get in a fight with a burglar and end up stabbing him to protect yourself from harm = probably ok

Get in a fight with a burglar, knock him out, tie him up and stab him through the head to teach him a lesson = probably not ok

We donít know what happened so canít say if the old guy is guilty.

The BBC report read to me like the suspect ie the murderer (unfortunately) was armed with a knife.

Edit screwdriver.

I hope he’s proven innocent and this doesn’t cause him too much grief.

Donít be silly...heís been arrested on suspicion of murder.

You canít expect the police on the scene to come to a snap decision that it was self defence, pat the pensioner on the head and say itís fine.

They have procedures to go through and a proper investigation of the evidence and circumstances.

When thatís complete, if the guy used a proportionate response in his self defence, he should be OK.

If he was indeed attacked in his own home, then Iíve every sympathy for him. But the police etc do have to establish that first.
