Planning Laws - Cricket Pitch could be lost

Just wondering if any peeps out there get involved with this sort of thing. Issue is this:

A cricket club has a lease from a private landowner ending next year. Landowner only wants to give club a one year get off lease so they can either build houses on the pitch or have a road running through it to give access to land adjacent to the pitch where it wants to build houses. The adjacent land was turned down for planning permission because of the local uproar it caused.

The council has a policy of not allowing sports grounds to be lost without an alternative being found, but as this is a private ground, the local housing development plan will probably trump the council's ground policy.

The end result could be a swap of land but locals don't want to have housing on either site anyway.

Has anyone gone through this type of experience and won or are there any anecdotes (perhaps with legal references) as to why housing developments were turned down?

I've got a little bit of related experience. From this experience, I believe that most planning law in the UK is in favour of development - the onus is on an objector to say why a development shouldn't go ahead rather than for the developer to have to prove their case. On the face of it, the bias in favour of development and the fact that this is private land means you will have a hard time saving the cricket pitch and preventing housing being built. I think any objections have to be on 'planning grounds' e.g. that the local environment can't support x no. of new houses, rather than the fact that there is a lot of local opposition.

One approach would be to actively engage the landowner and find out if it is possible to build the houses AND save (or relocate) the cricket pitch. I don't think most developers want to antagonise the local community, and this might help you shape the best outcome that you can get. Hope that helps in some way.

If you are serious, speak to a planning advisor. There will be charges for their advice, but if they think they can help you, its your best bet.
