Under English Law. The Supreme Court will decide if they agree.

They'll also decide whether they think the Scots judgement was right under Scots Law (which is apparently quite different)

Might also be a NI judgement which involves the GFA.

(but don't despair, they might decide it was all perfectly legal and by the board, after all. Why on earth shouldn't the PM shut Parliament to avoid Parliamentary scrutiny, if he or she wants to?)

Problem is, as it currently stand, the Court has ruled prorogation null & void. The Government haven't asked for that to be delayed, so right now they should all be streaming back to Westminster to catch up.

Don't know what the Government is playing at.

Whatever your views on the jurisdiction of the courts, you'd have to be some sort of massive twat to think it's ok for the PM to lie to the Queen to shut down Parliament to avoid its scrutiny.

You've answered your own question.

It's politics:

ē Clement Attlee caused George VI to prorogue parliament in 1948 to overcome opposition from the Lords to measures limiting their powers ó and their ability to block his reforms.

ē In 1997 John Majorís government was criticised for causing the Queen to prorogue parliament, allegedly to delay publication of the findings of a cash-for-questions inquiry.

oh yes - wonder what Scottish Law says though - probably goes right back to the Act of Union. Maybe even before, if said laws weren't repealed.

If it's illegal under Scots Law then its illegal. We are, in case you forget, a United Kingdom and Parliament is not an English Parliament.

Business Minister on Andrew Neil tonight....we really do seem to have a government that thinks it should be above legal scrutiny...

“The more the courts get involved in politics that is of detriment not only to politics but also the courts”

Business Minister Kwasi Kwarteng says judges involved with decisions on #Brexit are not biased, but says they are “interfering”

And.....

Now Business Minister @kwasikwarteng throws fuel on the fire. "Many Leave voters up and down the country are beginning to question the impartiality of the judges. They’re saying 'why are they getting involved in politics?'"

This is all directly out of the Trumpian playbook. Anyone who does not think that the US government is playing a direct role on the comms strategy that Boris and his team are taking, is deluded or a fool.

Pretty sure it's clear that breaking up the EU suits both Putin & Trump.

Excuse me, what a f***ing twat. Judges are there to rule on the legality of whatever is put in front of them, are they not? Does he think that a judge who rules on soneone's conservatory is "interfering in the planning process"? That a judge who awards damages for defamation is interfering in the freedom of the press? Or does he think that if a judge says what Twatface is doing is OK then he is not "interfering in politics"?

The judge is nerely doing his job which someone with a locus standi has paid him to do.

I guess to get into Boris' Cabinet you have to believe your own bullshit as well as his.

Iím not sure there are many points I have agreed with you on here so far but in global politics itís obvious the uk is a game to be played in the strategy of both.

A pawn that considers itself a queen. The uk is the pawn rushing to the other side to try to get queen again when itís over. Itís a bit sad really.

What's so weird about this as a possibility? Putin and Trump are cut from similar cloth and the US under Trump has clearly announced that the de facto US-China alliance that saw China enter the WTO and the world economy 25 years ago is now over and that America has now pivoted to Russia against China.

That US-China alliance was also, de facto, anti-Russian so Russia is delighted by the current state of play.

And as NickP says, both have a clear benefit in weakening the EU.

If the Supreme Court upholds the Scottish decision, Johnson must surely resign... but what if he doesn't? Would we expect the Queen to sack him?
