Yes it does and no it isn't. Very important point.

The "contract", such as it is, is with the driver because he's the only person they can say has seen it and has agreed to it by entering the car park. The registered keeper does not enter into the contract if he is not the driver.

Until Parliament and the Appeal Court decided to side with big business fraudsters instead of ordinary people, the operator could find out from the DVLA who the registered keeper is, and could tell the big business fraudster in return for a slice of their ill-gotten gains. That got them nowhere though because the driver was under no obligation to disclose who was driving.

But then Parliament passed something called the Protection of Freedoms Act 2012 and the scum companies brought a case against some poor sod who overstayed a few minutes. Never has there been a piece of legislation whose purpose was so diametrically opposite to its name. This legislation means that when one of these bullies writes to a registered keeper demanding to know who was driving his car the registered keeper is obliged to tell him. The scumbags now have free rein to take pictures of your car, find out who was using it, and extract money from them for nothing with the full blessing of the courts and the Government.

The only way is to a) not park in their car parks b) not shop in the shops they serve and c) tell the shopkeepers why.

Oh, and you'll never guess who runs the so-called appeals process. Clue: it's a total joke.
