How is a site like The BBS supposed to deal with this law?

How are we supposed to track down and pay the appropriate royalty to copyright holders for stuff that people post? We can watch the development of the law, but it has the potential to be a very serious issue for small websites like this. There was supposed to be thought given to providing an exemption for discussion forums, butbwhether that made it in or not I don’t know.

I was thinking about that when I posted the link as I did remember some one saying discussion forums would be exempt .

I may not post links till I am sure it doesn't effect board

From the sounds of it posting links to support argument as sources of information will be OK. Posting music or football footage for entertainment won't be.

Will those hell bent on stealing other people's content be stopped by this? Or just operate with servers outside the EU?

You'll have to watch out for people posting live football from Periscope, for sure. Otherwise why would you be worried? Has the BBS suddenly become for-profit?

I need to read the legislation properly to ensure we fall into an exemption of sorts. It won’t be easy as as you for profit, it’ll be are you the right form of not for profit entity.

... so if links to football footage or music is to support an argument, or reference the music of an artist under discussion, or to make a musical joke, in other words not strictly "entertainment" its ok?

I guess there needs to be a definition of "entertainment" ... some music might well be considered to be the opposite! )))

You'll have to check the transposition to UK law, but I can't envisage anything people do now on the BBS that they won't be able to do under the new directive. Nothing is changed in the nature of copyright.

The BBS links to footage from other platforms - it is those platforms that will be responsible for agreeing the licences.

It is probably a reflection on the EU (or government generally), that they take a issue that needs addressing and come out with such a broad piece of legislation that has unknown impacts on smaller providers and websites. The extent to which even big providers are expected to monitor it, what income to distribute, what they need to remove etc is cloudy and contradictory and will surely come down to case law - which is normal for legislation in the EU because of the need for compromise (as happens at local government level just more so I suppose).

There seems no exemption at all for message boards, review site setc. and they are expected to operate the same sort of filtering (if that is what is require) and removal as anyone else. And particularly for the BBS, part of the directive is specifically aimed at sports images. This filtering is both expensive and rather imprecise at the moment - i.e. how does it tell between a copyright clip and a meme? (Most filter software can't).

However, as I understand it but happy to be wrong, we don't need to worry yet as this has to be passed into law by each member state within 2 years? And each state has the capacity to reach it's own slightly different version of what the legislation means to enact. I have no idea the practicalities or scope of that, but it sounds a right mess. The likes of Italy were entirely against, so how far can they water it down?

Unsurprisingly, as there has been a spectacular amount of misinformation propagated around this directive by the world's most powerful and influential businesses, I see that most posters here are confused about its effects.

It will come down to platforms which set up as distributors of copyright material, negotiating licences with the holders of the rights. As far as smaller providers are concerned, they are exempt for their first three years until they turn over ten million euros per year. Article 2.5 is comprehensively specific about the type of services which will be liable and the BBS really does not fall under any of the possible definitions.

There is an exemption for review purposes (article 13.5 (a)). There is no obligation to filter (13.4 and 13.7).

Every EU directive is in the same position. Far more Italian MEPs voted for the directive than against it, by the way - but you are right that their current government opposes it. The actual transposition will be a complicated process everywhere, but mostly because of questions about translations of key terms (at least, that is my experience).
